You may not copy, reproduce, redistribute, republish, modify, sell, license, transmit, or exploit any portion of the Website’s content without our prior express written permission. Unauthorized use may result in civil liability, criminal penalties, and termination of your access to the Website.
You agree not to use the Website or any of its content in any way that violates these Terms or any applicable law. Breach of this section may result in immediate termination of your account, cancellation of orders, and pursuit of remedies available to us under law or equity.
3. Disclaimers and No Warranty
As-Is Basis. All products, services, and information provided through the Website are offered on an “as is” and “as available” basis. Nexus Peptides makes no warranties, representations, or guarantees of any kind — whether express, implied, statutory, or otherwise — regarding the Website, our products, or any information presented.
No Medical or Professional Advice. Information published on the Website is provided strictly for general educational and reference purposes related to laboratory research. Nothing on the Website should be interpreted as medical advice, clinical guidance, treatment recommendations, or factual claims regarding human or animal use.
Information Subject to Change. We reserve the right to add, modify, correct, remove, or update any content on the Website at any time without notice. We are not liable for errors, omissions, outdated content, pricing inaccuracies, inventory discrepancies, or any other information-related issues.
4. Research-Use-Only Restriction
Strictly for In-Vitro Laboratory Research. All products sold by Nexus Peptides are intended solely for in-vitro laboratory research, analytical testing, or scientific investigation conducted in an appropriate research setting by qualified individuals.
Not Evaluated by the FDA. Our products have not been reviewed, evaluated, or approved by the U.S. Food and Drug Administration or any other regulatory body for the prevention, treatment, diagnosis, mitigation, or cure of any disease, condition, or health issue.
Strictly Prohibited Uses. You agree and acknowledge that no product purchased from Nexus Peptides will be used, ingested, consumed, injected, applied, administered, compounded, prepared for administration, or otherwise utilized in or on any human or animal under any circumstances whatsoever. Our products are absolutely not intended for consumption or therapeutic use in any form.
Our products are not supplements, drugs, medications, foods, cosmetics, medical devices, dietary additives, or consumer products. They are research-grade chemical compounds intended exclusively for qualified scientific research conducted in a suitable laboratory environment by knowledgeable, authorized individuals.
5. Pricing, Availability, and Right to Refuse
Pricing Changes. Nexus Peptides reserves the right to modify prices, discontinue products, end promotions, alter discounts, and change product availability at any time without advance notice. We may also correct pricing errors, product description mistakes, inventory inaccuracies, and other Website or checkout errors at any time before or after order placement.
Right to Refuse Service. We reserve the absolute right to refuse service, deny sales, cancel orders, limit purchase quantities, suspend accounts, or restrict Website access for any reason — including but not limited to legal compliance concerns, payment processor requirements, fraud prevention, risk management, suspected misuse, operational issues, or any other business reason at our sole discretion.
We may decline or void any order if we reasonably suspect that the order, the customer, the payment method, the shipping destination, the stated intended use, or any other related factor may breach these Terms, violate applicable laws, conflict with payment processor or carrier policies, or trigger our internal risk-management protocols.
6. Customer Representations and Responsibilities
By purchasing from Nexus Peptides, you affirm, represent, and warrant that you have independently conducted reasonable research and review regarding:
- The proper intended use of each product as a laboratory research material.
- All relevant warnings, dangers, hazards, storage requirements, handling guidelines, and safety considerations associated with these compounds.
- The legality and regulatory status of purchasing, possessing, storing, transporting, and handling these products in your specific jurisdiction — including federal, state, county, and municipal laws.
- Your personal capability, professional qualifications, laboratory facilities, and lawful authority to receive, possess, store, handle, and use these products strictly for research.
You acknowledge that you bear sole responsibility for determining whether each product may be lawfully purchased, received, possessed, stored, handled, used, transferred, or otherwise obtained in your jurisdiction.
7. Prohibited Uses of Our Products
By purchasing from Nexus Peptides, you understand and explicitly agree that our products are NOT offered or sold for human or animal consumption of any kind, in any form, by any method whatsoever. If you do not accept this restriction, do not place an order with us.
Our products may not be combined, blended, mixed, compounded, processed, or otherwise prepared for any purpose involving consumption, ingestion, injection, administration, application, or use in or on any human or animal — for any reason, commercial or personal.
Our products are not intended for use as supplements, dietary aids, foods, beverages, cosmetics, drugs, medicines, health products, medical devices, or any other consumer-facing product, whether for individual or commercial distribution.
All products offered by Nexus Peptides are sold strictly for laboratory research purposes and must be handled exclusively in an appropriate scientific research setting by individuals possessing adequate qualifications, training, authorization, or professional licensure as applicable to their jurisdiction.
8. Customer Testing, FDCA, and Regulatory Compliance
You further agree that any product purchased from Nexus Peptides will be independently examined, tested, and verified by you or your qualified personnel to confirm compliance with all applicable efficacy, safety, handling, labeling, storage, and regulatory standards before any subsequent manufacturing, research, marketing, transfer, or downstream use.
All research and testing activities involving our products must be carried out by experienced, qualified, authorized, and (where required) properly licensed researchers in compliance with all statutory and regulatory laws currently in effect or subsequently enacted.
You agree that products purchased from Nexus Peptides will not be altered, modified, adulterated, mislabeled, misbranded, or otherwise handled in any manner that violates the Federal Food, Drug, and Cosmetic Act (FDCA), the Toxic Substances Control Act (TSCA), or any other applicable federal, state, local, or international law or regulation. You bear sole responsibility for confirming that your purchase, possession, research, handling, storage, and use complies with all applicable legal and regulatory requirements.
9. Hazards, Handling, and Verification
By purchasing from Nexus Peptides, you acknowledge and accept full and exclusive responsibility for independently verifying the hazards, risks, legal status, regulatory requirements, proper handling procedures, storage conditions, and research suitability of every product you purchase.
You further agree to conduct any research, testing, or experimental activity involving our products only in a lawful, controlled, and properly equipped research environment by qualified personnel.
You acknowledge that Nexus Peptides shall bear no liability for any damages — direct, indirect, or consequential — arising from a customer’s failure to comply with these Terms, or resulting from any abuse, negligence, mishandling, misuse, improper storage, unlawful conduct, or other matter related to any product or service provided.
10. Indemnification and Hold Harmless
Hold Harmless. By purchasing any product from Nexus Peptides, possessing or using any product purchased from us, or using the Website, and in consideration of our willingness to process your order, you agree to hold Nexus Peptides harmless from any and all claims arising under any legal theory — including contract, strict liability, negligence, breach of duty, product liability, misuse, possession, handling, storage, unlawful use, or any other theory — related to the purchase, use, possession, handling, or storage of any of our products.
Indemnification. You agree to indemnify, defend, and hold harmless Nexus Peptides and its owners, officers, directors, employees, contractors, agents, affiliates, partners, representatives, and service providers from and against any and all claims, lawsuits, demands, damages, liabilities, losses, costs, expenses, and attorneys’ fees brought by any third party arising out of or relating to: your use of the Website; your purchase, possession, handling, or use of our products; your violation of these Terms; your violation of any applicable law or regulation; or your violation of any third-party rights.
11. Returns, Refunds, and Order Issues
Final Sale Policy. Due to the specialized nature of research chemicals and our strict quality-control protocols, all sales are final unless otherwise required by applicable law or specifically approved by Nexus Peptides at our sole discretion.
All matters related to shipping, processing, tracking, delivery, returns, replacements, exchanges, and refunds are governed by our separately posted Shipping Policy and Refund and Return Policy. These policies are incorporated by reference into these Terms.
If your order arrives damaged, defective, incorrect, or with missing items, you must notify us within the timeframe established in our Refund and Return Policy. To process any claim, you must provide your order number, a detailed description of the issue, and clear photographic or video evidence of the package and its contents.
12. Account, Checkout, and Communications
You are solely responsible for providing accurate and current account, billing, shipping, contact, and payment information. Incomplete or inaccurate information may cause shipping delays, failed delivery, order matching problems, rewards-program errors, or other account-related issues for which we bear no liability.
By creating an account, placing an order, subscribing to notifications, contacting customer service, or otherwise interacting with the Website, you consent to receive transactional, service-related, order-related, account-related, and support-related communications from us. Marketing, restock, and promotional communications will be sent only where you have opted in or where otherwise permitted by law, and you may opt out at any time.
When you complete a checkout or indicate acceptance of our terms during the order process, you confirm your agreement to these Terms and Conditions, our Privacy Policy, Shipping Policy, Refund and Return Policy, all research-use disclaimers, all product disclaimers, and all other disclosures presented on the Website.
13. Website Availability
Nexus Peptides makes reasonable efforts to keep the Website continuously available. However, due to the inherent nature of web hosting, software updates, third-party integrations, payment systems, security infrastructure, and similar technical dependencies, the Website may become unavailable from time to time, without notice, for any duration, for any reason.
You agree that Nexus Peptides shall not be liable for any damages, losses, or inconveniences resulting from the Website being unavailable at any time, for any reason. We reserve the right to update, modify, alter, restrict, suspend, or discontinue any aspect of the Website, which may result in temporary disruptions, delays, errors, or unavailability.
You agree to use the Website only for lawful personal or authorized organizational purposes related to reviewing information, managing your account, or purchasing products for legitimate research.
14. Force Majeure
Neither party shall be liable for any failure or delay in performance to the extent caused by circumstances beyond that party’s reasonable control. Such circumstances include, but are not limited to: natural disasters, severe weather, fires, floods, earthquakes, pandemics, public health emergencies, acts of war or terrorism, civil unrest, riots, labor disputes, governmental actions or regulations, internet outages, hosting disruptions, payment processor failures, supply-chain disruptions, customs or border delays, carrier delays, vehicle accidents, lost shipments, stolen mail, and similar events outside reasonable control.
Nexus Peptides specifically disclaims responsibility for lost shipments, shipping delays, supply-chain disruptions, backorders, lost or stolen mail, and customs delays that occur after a package leaves our facility.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Nexus Peptides shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including but not limited to lost profits, lost data, lost revenue, lost goodwill, or business interruption — arising out of or relating to: your use of the Website; your purchase, receipt, possession, handling, storage, or use of our products; carrier delays; Website downtime; payment processing issues; third-party service failures; or any other matter outside our direct control.
Our total cumulative liability to you for any claim arising out of or relating to these Terms or your purchase shall not exceed the total amount you paid to Nexus Peptides for the specific product giving rise to the claim.
Nothing in these Terms is intended to limit liability where such limitation would be prohibited by applicable law.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any conflict-of-laws principles. The exclusive venue for any dispute, claim, or proceeding arising out of or related to these Terms or your use of the Website shall be the state and federal courts located in Sacramento County, California.
In lieu of court proceedings, you and Nexus Peptides agree that any dispute shall first be submitted to binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Sacramento, California.
Class Action Waiver. You expressly waive any right to participate as a plaintiff or class member in any purported class action, collective action, or representative proceeding against Nexus Peptides. All claims must be brought in an individual capacity.
17. Entire Agreement and Severability
Entire Agreement. These Terms, together with our Privacy Policy, Shipping Policy, Refund and Return Policy, checkout acknowledgments, product disclaimers, research-use disclaimers, and all other disclosures published on the Website, constitute the entire agreement between you and Nexus Peptides regarding the subject matter herein. They supersede all prior or contemporaneous written or oral communications, agreements, representations, and understandings.
Severability. If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified or severed only to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Headings. Section headings are provided for convenience only and shall not affect the interpretation or meaning of any provision.
No Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it later.
18. Modifications to These Terms
Nexus Peptides may update, change, amend, or revise these Terms at any time by posting the revised version on this page. No modifications shall be valid or binding unless made through this process. Continued use of the Website after any update constitutes acceptance of the revised Terms.
19. Compliance Monitoring and Anti-Misuse
Nexus Peptides may monitor orders, account activity, customer communications, and other available information for signs of misuse, unlawful activity, prohibited human or animal use, unauthorized resale, misrepresentation, or other violations of these Terms.
We reserve the right to cancel orders, suspend or terminate accounts, decline service, refuse support requests, or take any other appropriate action if we suspect a customer is in violation of these Terms, applicable laws, product-use restrictions, payment processor requirements, or our internal compliance standards.
Nexus Peptides does not, under any circumstances, provide guidance regarding dosing, administration, injection, consumption, therapeutic application, or any other human or animal use of our products. All such inquiries will be declined and redirected to our public-facing research-use disclaimers.
Final Research-Use Disclaimer. All Nexus Peptides products are sold strictly for research, laboratory, analytical, or scientific purposes only. Our products are NOT for human consumption, NOT for animal consumption, and NOT intended for any diagnostic, therapeutic, medical, cosmetic, supplement, food, drug, or consumer use whatsoever.
